This is from Mungo Graham of Gorthie to James Graham the 1st Duke of Montrose and 4th Marquess of Montrose of an obligation by John MacFarlane and his father Andrew to deliver certain writs (deeds) and sasines (title documents) regarding the 10 pound land of Nether Arrochar. John is the 8th Baron of Gartartan, owner of Barony of Auchentroig and 1st of Ballagan while his elder brother Alexander MacFarlane was the 7th Baron of Gartartan and Andrew MacFarlane their father was the 6th Baron of Gartartan. John now has been left to deal with the situation regarding the Duke of Montrose and completion of the sale of lands with litigation and disbursements for the purchase and price. This land sale initially commenced in 1720 but in 1736 all legal matters and papers are still not completed to the satisfaction of the Duke.

This is a renunciation of several rights, interests, or diligences affecting the land of Neither Arroquhar which the Duke of Montrose is still attempting to gain control of since he purchased it in 1720. Several bonds or promissory notes against the land originally taken by Alexander and Andrew Mcfarlane are mentioned. Also mentioned are Robert Graham, 3rd of Gallingad and 4th of Gartmore (M.D.) with his son Nicol Graham 4th of Gallingad and 5th of Gartmore (M.P.). James Graham the 1st Duke of Montrose and 4th Marquess of Montrose had been litigating against Alexander MacFarlane and his father Andrew. Alexander MacFarlane was the 7th Baron of Gartartan and Andrew MacFarlane was the 6th Baron of Gartartan. Alexander’s younger brother John now the 8th Baron of Gartartan, owner of Barony of Auchentroig and 1st of Ballagan had been left to deal with the situation regarding the Duke of Montrose and completion of the sale of lands with litigation and disbursements for the purchase and price. Muniment Hill 58 was created April 29, 1729, by James Robertson of Edinburgh. It has been transcribed/translated and is now available for CMW members to read on the website under Muniments.
This is a discharge and renunciation by Anna Graham at one time the spouse of Alexander Mcfarlane but now divorced regarding any of her rights and claims against the lands of Nather Arrochar and the sale to the Duke of Montrose. This is in favour of James Duke of Montrose regarding that sale in 1720 (refer to Muniment Hill 50) by Andrew Mcfarlane of Gartartan. This sale was complicated by the divorce of Anna Graham the second daughter of John Graham of Killearn (Hill 54 & 57) from Alexander MacFarlane in 1720.
